Mintsifra clarified new rules for accredited IT companies

MOSCOW, October 1 – Novosti. Accredited IT companies will need to send their consent to the disclosure of tax secrets to the Federal Tax Service within a month from the date of entry into force of the new accreditation procedure in order to undergo an audit for compliance with the new requirements for these organizations, according to the Ministry of Digital Development of the Russian Federation.
Earlier on Saturday, the Cabinet of Ministers of the Russian Federation approved new rules for the accreditation of IT companies, according to which revenue from activities in the field of information technology must be at least 30% of the company’s total income, and its employees must receive a salary not lower than the average for the country or the subject of registration.

“If your company is already accredited, then you do not need to re-apply now. BUT! Such a company must, within a month from the date the new procedure enters into force, send consent to the Federal Tax Service to disclose information constituting a tax secret (in order to pass an audit for compliance with the requirements, presented to accredited IT companies),” the statement says.
The agency also noted that “the new regulation on accreditation provides that, in relation to, among other things, already accredited organizations, annually until July 1 (starting from 2023) a procedure will be carried out to confirm compliance with the requirements for accredited IT companies, under which organizations it will be necessary to provide information on income from activities in the field of IT. The Ministry of Digital Transformation may also conduct an unscheduled audit.”
It is also noted that IT startups that do not have revenue can now receive accreditation. To do this, the average salary of employees in them must not be lower than the average for the country or region, the company must be established less than 3 years before the application is submitted, and its income must be less than 1 million rubles from the moment of creation. In addition, a startup must have a specialized IT-OKVED as the main one, and information about the organization’s activities in the IT field must be posted on its website. When submitting documents for accreditation, such a project must also be registered in the regional register of start-ups, if it exists in the subject.
