MOSCOW, December 6 – Novosti. The State Duma Committee on the Financial Market supported the adoption in the first reading of a bill that secures on a permanent basis the right of citizens to credit holidays on consumer loans (loans).
The document, submitted by a group of senators and deputies, is aimed at supporting citizens who have entered into a consumer credit (loan) agreement and find themselves in a difficult life situation. It can be submitted to the Duma on December 8 or 13.
The draft law provides for the right of a borrower who has entered into a consumer credit (loan) agreement, the amount of which does not exceed the value determined by the Russian government , to apply to the lender with a request for a grace period for up to six months, during which he has the right not to make payments under such an agreement.
Such a right can be exercised once during the term of the loan agreement and subject to a decrease in the borrower’s income by more than 30% compared to the average monthly income of the borrower (the total average monthly income of all borrowers) calculated for the year. Information about granting a loan holiday to a borrower will be reflected in his credit history, but will not worsen it.
During this grace period, it is prohibited to charge a penalty (fines, penalties), foreclose on the subject of collateral, contact the borrower’s guarantor, however, interest will be charged on the borrower’s current debt.
Until the Cabinet of Ministers establishes the maximum amount of credit (loan) for which the borrower is entitled to apply for credit holidays, the limit values established by the bill will apply. For credits (loans), the obligations of the borrower on which are secured by a pledge of a vehicle, the limit will be 1.6 million rubles, for the rest – 450 thousand rubles. And for consumer credit (loan) agreements with a credit limit, under which the borrower has the right to apply for a vacation, the issuance limit or debt limit (the smallest of these values) will be 150 thousand rubles.
